Dispute resolution generally involves alternative dispute resolutions such as mediation and arbitration proceedings. It is a way of resolving disputes without a lawsuit, which can involve costly and time consuming trials. However, these alternative dispute resolution proceedings still will incur significant legal fees and time.
Mediation is a proceeding wherein a neutral mediator meets with the disputing parties to try to help them reach a resolution. The mediator does not make decisions, but shows each side to the dispute the strengths and weaknesses of their positions and the risks of resorting to a lawsuit.
Arbitration is a proceeding less formal than a trial wherein an arbitrator makes decisions after hearing each party in the dispute. Generally the same evidence rules apply as in trials. There are very limited appeal rights to the decision the arbitrator makes.
