Disputes with contractors working on a construction project is, unfortunately, a common situation. Sometimes it results from an unfortunate misunderstanding. Sometimes a dispute arises because either the contractor or the project manager or owner of the property have acted wrongly in some way.
Contractor Liens. Contractors do have the benefit of Florida contractor lien laws which enable a contractor to assert a lien when it performs services or provides labor or materials. As long the contractor follows specific procedures, it can assert and enforce its lien rights. However, the owner can raises defenses to the contractor’s claims. Especially if the owner is claiming that the work was not performed as a contractor or was poorly done.
